a) What is it?
The RingTagz Service is provided by Muzicall Limited, registration number 04964271, whose registered address is 233 High Holborn, London, WC1V 7DN. The RingTagz service is a service on which an audio ringback tone (a 'Ringback Tone' or 'RingTagz') is transmitted or played between yourself and the person you are phoning, instead of a UK standard ITU Tone. Some Ringback Tones are provided to you free of charge ('Free Tracks') and other Ringback Tones are available for sale and may cost up to £1.50 per track ('Paid-For -Tracks').
b) How does it work?
You will be required to select a Free Track or a Paid-For-Track, where after we will process your request to join the RingTagz Service.
c) Who can join the RingTagz service?
You can join the RingTagz service if you are a T-Mobile customer who Pays Monthly, or Pays by Direct Debit, or if you Pay As You Go.
You have to pay a £1.50 monthly playing fee ('Monthly Playing Fee') to use the RingTagz Service.
e) Pay Monthly or Pay by Direct Debit:
If you Pay Monthly or Pay by Direct Debit, the price of your Monthly Playing Fee will be added to your monthly bill at the time of your first purchase and thereafter on each renewal date. The Monthly Paying Fee will appear as a premium rate SMS on your bill. If we are unable to add it to your bill or collect payment on your Monthly Playing Fee renewal date, we will attempt to add it to your bill or collect payment for up to 30 days. You will continue to receive the RingTagz Service during this period. Your RingTagz Service will be deactivated if we are still unable to invoice you or collect payment after 30 days.
f) Pay as You Go:
If you are a Pay As You Go customer, your Monthly Playing Fee will be deducted from your airtime balance at the time of your first purchase and thereafter on each renewal date. If you do not have sufficient credit at the time your Monthly Playing Fee is due, you will continue to receive the RingTagz Service. For a period of up to 30 days we will attempt to deduct the Monthly Paying Fee from your credit. If you do not top up by the end of that 30 day period, your RingTagz service will be deactivated.
g)You will not be able to subscribe to the RingTagz Service if your account is barred from making premium rate SMS. If you have already subscribed to the RingTagz Service and are later barred from sending premium rate SMS then you will still receive the RingTagz Service until the next renewal date, at which time you will automatically be unsubscribed.
h) You can subscribe to the RingTagz Service again within 60 days following the deactivation of the RingTagz Service (under (e) or (f) above), by selecting a Free Track or a Paid-For-Track. Your RingTagz Service will then resume and all Ringback Tones previously purchased or received as a free promotion will be available to you again. If you do not subscribe to the RingTagz Service again in the 60 days following the deactivation, all Ringback Tones purchased or received as a free promotion will be lost.
i) Removal of Content: It lies within T-Mobile’s sole discretion to remove Ringback Tones from the RingTagz Service for legal or rights issues or as otherwise provided for herein. In the event of such removal, T-Mobile may (but is not obliged to) offer you a replacement Ringback Tone to the value of the Ringback Tone which was removed. No refunds are payable.
j) Changing of Content:
It lies within Muzicall’s sole discretion to add a pre-roll message to any Ringback Tones from the RingTagz Service. No refunds are payable in respect of the same.
You can unsubscribe from the RingTagz Service at any time up to 48 hours before it is due to be renewed on your mobile or via web. To unsubscribe
(i) via WAP: go to the T-Mobile Web ‘n’ Walk where from the Homepage you will need to select Music, and then scroll down to RingTagz. From the RingTagz Homepage select ‘My RingTagz' and under Settings click on 'Stop RingTagz
(ii) via SMS: SMS STOP to 88188.
(iii) via web: go to www.ringtagz.co.uk on your PC and log in (or register if this is a first visit). Under Settings click on ‘Stop RingTagz’.
Any Ringback Tone purchased by you will be available indefinitely or as otherwise notified at the time of purchase, unless:
(i) you fall in arrears with payment of the Monthly Playing Fee; or
(ii) you unsubscribe (as per (j) above); or
(iii) if you or the mobile number to which a Monthly Playing Fee is applied is suspended or disconnected.
m)Consequences of termination:
If you unsubscribe from the RingTagz Service through the RingTagz WAP site, you will have the option to end your subscription thereto either immediately, or on your next billing date. If you unsubscribe via SMS or via the website your subscription will end on your next billing date. Where you end your subscription immediately, any remaining (paid for) days of that month will be lost. No refund for any unused elements of your RingTagz Service will be available, but this does not affect your legal rights as a consumer. If you do not subscribe to the RingTagz Service again within 90 days from the date of termination, you will lose access to the RingTagz Service as well as all the Ringback Tones that you have previously purchased or received as free promotion.
A Ringback Tone is non-transferable and cannot be exchanged for cash. We reserve the right to change or withdraw the RingTagz Service at any time. If we do, we will give you as much notice as we reasonably can.
If you download Ringback Tones whilst roaming, you will be charged for data at the applicable roaming rates.
p)If you have activated network sharing on your T-Mobile mobile and are using an Orange signal, RingTagz you have purchased may not function. They will continue to play again when you return to using a T-Mobile signal.
q) (FREE) Tracks
Tracks that are marked (FREE) have a 5 second marketing message attached to them. This cannot be switched off and is not optional. In order to have the track without the marketing message the premium version should be selected. For the avoidance of doubt these are the tracks without ‘(FREE)’.
